By accessing our Site or purchasing our Products, you agree to be bound by these Terms. Please read them carefully. If you do not agree with these Terms, you must not access our Site or purchase our Products.

## 2. MEDICAL DISCLAIMER

### 2.1 Emergency Medical Device

The Hema-T™ tourniquet is an emergency medical device intended for use in situations of severe bleeding from an arm or leg to prevent life-threatening blood loss. It is designed to be used when professional medical help is not immediately available.

### 2.2 Not a Substitute for Professional Medical Care

Our Products are not a substitute for professional medical training, diagnosis, treatment, or advice. Always seek the advice of qualified medical professionals for any medical emergency. Our Products are designed to be temporary measures until professional medical care can be obtained.

### 2.3 Training Recommendation

While the Hema-T™ is designed for intuitive use without prior training, we strongly recommend that all users familiarize themselves with proper application techniques and emergency response procedures before an emergency occurs. The instructional materials provided with the Product should be reviewed thoroughly before use.

## 3. PRODUCT INFORMATION AND ORDERING

### 3.1 Product Descriptions

We strive to ensure that all information about our Products on the Site is accurate and complete. However, we do not warrant that Product descriptions or other content on the Site are accurate, complete, reliable, current, or error-free.

### 3.2 Order Acceptance and Confirmation

Your receipt of an order confirmation does not constitute our acceptance of your order. We reserve the right to accept or decline your order for any reason up until the time we ship the Products to you.

### 3.3 Pricing and Payment

All prices displayed on our Site are in U.S. dollars and do not include taxes or shipping costs, which will be added at checkout. We reserve the right to change prices for Products displayed on our Site at any time.

## 4. USAGE LIMITATIONS AND WARNINGS

### 4.1 Maximum Application Time

The Hema-T™ tourniquet should not remain on a limb for more than 2 hours. Prolonged use beyond the recommended time limit may result in tissue damage, limb loss, or other serious medical consequences.

### 4.2 Contraindications

Do not use the Hema-T™ on patients with Deep Vein Thrombosis (DVT). The Product is not suitable for use on children under 7 years of age for leg applications and under 15 years of age for arm applications. The Product is designed for limbs with circumferences between 30-80cm.

### 4.3 User Responsibility

Users are solely responsible for ensuring proper use of the Product in accordance with the provided instructions. Improper application may result in the Product's failure to stop bleeding or in unwanted side effects.

## 5. LIMITED WARRANTY

### 5.1 Product Warranty

We warrant that the Hema-T™ tourniquet will be free from material defects in materials and workmanship when delivered. This warranty is valid for one (1) year from the date of purchase.

### 5.2 Exclusions and Limitations

This warranty does not cover damage resulting from improper use, accidents, neglect, misuse, alteration, or normal wear and tear. The warranty is void if the Product packaging seal is broken or shows evidence of tampering before emergency use.

### 5.3 Warranty Claim Procedure

To make a warranty claim, please contact our customer service department at [support@ranchosurvivalist.com] with proof of purchase and a description of the defect.

## 6. LIMITATION OF LIABILITY

### 6.1 Disclaimer of Warranties

EXCEPT AS EXPRESSLY SET FORTH IN THESE TERMS, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, AND WE HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE PRODUCTS, EITHER EXPRESS, IMPLIED, OR STATUTORY.

### 6.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR PERSONAL INJURY, OR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE PRODUCTS.

### 6.3 Liability Cap

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID FOR THE APPLICABLE PRODUCT.

## 7. INDEMNIFICATION

You agree to defend, indemnify, and hold us harmless from and against any claims, damages, costs, liabilities, and expenses (including, but not limited to, reasonable attorneys' fees) arising out of or related to your use of the Products, including, without limitation, any actual or threatened claim that your use of the Products violates any applicable laws or regulations or infringes the rights of any third party.

## 8. GOVERNING LAW AND DISPUTE RESOLUTION

### 8.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the state of California, without giving effect to any principles of conflicts of law.

### 8.2 Dispute Resolution

Any dispute arising from or relating to these Terms or your use of the Products shall first be resolved through good faith negotiations. If such negotiations fail, any controversy or claim shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association.

### 8.3 Waiver of Class Actions

YOU AND RANCHO SURVIVALIST AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

## 9. CHANGES TO TERMS

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site. Your continued use of the Site or our Products after any changes to the Terms constitutes your acceptance of such changes.

These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference herein, constitute the entire agreement between you and us concerning the Site and the Products.

Common items in a terms and conditions agreement allow you to:

• Withdraw and cancel services, and make financial transactions.
• Manage customer expectations, such as liability for information errors or website downtime.
